Terms of Service

These Terms govern your use of HostMyVideo. They are written to be readable, but they are a binding agreement between you and QueryWing (the operator of HostMyVideo). If you are accepting these Terms on behalf of a company, you confirm you have authority to bind that company.

1. Acceptance

By creating an account, uploading content, or using HostMyVideo in any other way, you accept these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Account & eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use HostMyVideo. You agree to provide accurate registration information, keep it current, and protect your credentials. You are responsible for all activity under your account, including activity by team members you invite. Notify us at support@querywing.com if you suspect unauthorised access.

3. Acceptable use

You may not use HostMyVideo to upload, host, or distribute content that:

• infringes copyright, trademark, or other intellectual-property rights you do not own or have a licence to host;
• constitutes child sexual abuse material (CSAM) — we report all such content to the National Center for Missing & Exploited Children and to local authorities;
• contains malware, exploits, or content designed to compromise viewers' devices;
• harasses, threatens, or targets specific individuals;
• incites violence or constitutes credible threats;
• violates applicable export, sanctions, or privacy law;
• is intended to defraud viewers (e.g. impersonation, deceptive financial promotions).

We may remove offending content and suspend or terminate accounts that violate this section. We are not obliged to monitor your content but we reserve the right to.

4. Plans, billing, and refunds

Paid plans are billed monthly or annually in advance, in US dollars, via Stripe. Upgrades take effect immediately and are prorated for the remainder of the billing period. Downgrades take effect at the next renewal. You may cancel at any time from your billing page; cancellation stops future charges but does not refund the current period. Except where required by law, fees are non-refundable.

5. Bandwidth, storage, and overage

Each plan includes a monthly bandwidth and storage allowance. If you exceed it, we will either notify you and meter overage at the published per-GB rate, or — for free and trial accounts — throttle delivery until the next cycle. We do not knock out customer-facing embeds without warning. Sustained overage may require an upgrade.

6. Intellectual property

You keep all rights to the videos you upload. We do not claim ownership over your content. To run the service, you grant HostMyVideo a worldwide, non-exclusive, royalty-free licence to host, transcode, cache, transcode-derived (chapters, transcripts), and deliver your content to viewers you authorise. This licence ends when you delete the content, subject to backup retention described in our Privacy Policy.

The HostMyVideo platform — including code, design, brand assets, and documentation — is owned by QueryWing. These Terms do not transfer any of those rights to you.

7. Termination

You may close your account at any time. We may suspend or terminate your account if you materially breach these Terms, fail to pay, or use HostMyVideo in a way that exposes us or our infrastructure providers to legal risk. Where the breach is curable we will, where reasonable, give you notice and a chance to fix it. On termination your right to use the service ends and we will follow the data-deletion timelines in our Privacy Policy.

8. Disclaimers and limitation of liability

HostMyVideo is provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, or perfectly secure, although we work hard at all three. To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is capped at the total fees you paid us in the twelve months preceding the event giving rise to the claim, or USD $100 if you are on a free plan. Neither party is liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

10. Changes

We may update these Terms from time to time. If a change is material we will give reasonable notice — at minimum, an email to your account address and a banner in the app — at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
